KrishiScan by ELLOTH — AI crop doctor + YojanaAI

These Terms of Service ("Terms") govern your access to and use of the KrishiScan platform and its component products — KrishiScan Diagnose, Profit AI, and YojanaAI (collectively, the "Services") — provided by ELLOTH ("ELLOTH", "we", "our"), an independent technology company founded and owned by Abir Majumder.

1. Acceptance of terms

By creating an account, submitting a diagnosis, running a profit prediction, chatting with YojanaAI or otherwise using any part of the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

2. The Services

KrishiScan is a progressive web app that combines several AI-powered tools for Indian agriculture:

KrishiScan Diagnose — upload or capture a crop photo and receive an AI-inferred diagnosis (disease, pest or deficiency), organic and chemical remedies, and text-to-speech playback in one of 10 Indian languages.
Profit AI — an alternative-crop profitability predictor using district-level mandi rates, weather forecasts and soil heuristics. Output is a ranked list of crops with expected profit uplift.
YojanaAI — a six-question interview that returns a categorised list of central and state government schemes, subsidies, bank loans, insurance and grants you may qualify for, with official portal links.

3. Eligibility & account

You must be at least 18 years old to create an account.
You must provide accurate information (email, name, state) and keep it up to date.
You are responsible for keeping your password confidential. Notify us immediately of any unauthorised access.
Multiple accounts to circumvent the free-tier scan quota are prohibited.

4. Acceptable use

You agree NOT to:

Upload images that are not agricultural in nature, or that are illegal, obscene, defamatory or infringe others' rights.
Attempt to bypass authentication, admin controls, quota checks or payment gates.
Scrape, replicate or resell scheme data, Profit AI predictions or diagnosis outputs without a separate written licence from ELLOTH.
Use the Services to spread mis-advice that could damage another farmer's crop.
Interfere with our infrastructure, run denial-of-service attacks or overload the LLM endpoints.
Reverse-engineer, decompile or attempt to extract our prompts, model weights or proprietary agronomic heuristics.

5. Advisory nature of AI output

KrishiScan's AI output — diagnoses, remedies, profitability predictions and scheme suggestions — is advisory only. It is generated by large language models (currently Google Gemini via the Emergent LLM Key) and may occasionally be wrong, incomplete or out-of-date. You are strongly advised to:

Cross-verify diagnoses with a local Krishi Vigyan Kendra (KVK) or state agriculture officer before spraying chemicals.
Confirm mandi rates on your state's official Agmarknet portal before switching crops based on Profit AI predictions.
Verify eligibility, benefits, deadlines and application steps for every YojanaAI-suggested scheme on the official government portal linked from within the app. ELLOTH is not affiliated with, endorsed by or acting on behalf of the Government of India or any state government.

Bank loan information is presented for research purposes; final approval, interest rates and terms are set solely by the lending institution.

6. Plans, pricing & payments

The Services offer both free and paid tiers. Prices, features and scan quotas below are subject to change; the pricing shown at the time of purchase on the Pricing page governs.

KrishiScan Diagnose

Free (ks_free) — ₹0. 3 diagnoses per month. English + Hindi output.
Farmer (ks_farmer) — ₹299/month. 200 diagnoses/month, all 10 languages, TTS, voice output and offline queue.
FPO / Cooperative (ks_fpo) — ₹1,999/month. Unlimited scans, all 10 languages, priority support.

YojanaAI

Free (yo_free) — ₹0. 1 completed interview.
Individual (yo_individual) — ₹99. 5 interviews / calendar month.
Farmer & SMB (yo_smb) — ₹299. 20 interviews / month.
Consultant / Agent (yo_consultant) — ₹999. Unlimited interviews and full scheme catalogue export.

Admins / Owner: The account tied to the ADMIN_EMAIL environment variable has unrestricted access to every feature at no cost, for the sole purpose of platform administration and testing.

Payment processing: paid subscriptions are processed by Razorpay Software Private Limited. We do not store your card, UPI PIN or netbanking credentials.

7. Cancellations & refunds

You can cancel a paid subscription at any time from the pricing / subscription page. Access continues until the end of the paid billing period.
Refunds are considered on a case-by-case basis within 7 days of purchase. Email contact@elloth.in with your payment reference and reason.
No refunds are issued for scans / interviews already consumed during the billing period.
Fraudulent chargebacks may result in permanent account termination.

8. Third-party services

The Services rely on third-party providers listed in our Privacy Policy (Google Gemini, Razorpay, Open-Meteo, OpenStreetMap Nominatim, Google Maps public embed). By using the Services you accept those providers' terms in respect of the data they receive. ELLOTH is not responsible for outages or defects on those providers' side, though we will do our best to restore service promptly.

9. Intellectual property

The KrishiScan, ELLOTH, Profit AI and YojanaAI names, logos and brand marks are trademarks of ELLOTH.
All software, prompts, agronomic heuristics, scheme normalisation logic, UI design and documentation are © 2026 ELLOTH and licensed solely for your personal use of the Services.
Government scheme names, benefit amounts and portal URLs are public information owned by the respective ministries and reproduced under fair use.

10. Your content

You retain ownership of any crop photos, chat messages or text you submit ("Your Content"). By submitting Your Content, you grant ELLOTH a worldwide, royalty-free licence to process it strictly to deliver the Services back to you. ELLOTH does not sell, publish or use Your Content to train third-party foundation models beyond transient inference.

You can delete Your Content anytime from the /history page. Deletion is immediate and irreversible.

11. Termination

We may suspend or terminate your access if you violate these Terms, engage in abusive behaviour or file a fraudulent chargeback. You may delete your account at any time by emailing contact@elloth.in.

12. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement or accuracy of AI predictions. Yield outcomes depend on countless external factors (rainfall, pests, market prices, policy) beyond ELLOTH's control.

13. Limitation of liability

To the maximum extent permitted by law, ELLOTH and its founder shall not be liable for any indirect, incidental, special or consequential damages — including crop losses, missed subsidies, bank interest, mandi-price differences or third-party actions — even if advised of the possibility.

Our aggregate liability for any claim arising out of the Services shall not exceed the amount you paid us in the 12 months preceding the claim (or ₹500 if you use only the free tier).

14. Indemnity

You agree to indemnify ELLOTH and Abir Majumder against any claims resulting from (a) content you upload, (b) misuse of AI advice, or (c) breach of these Terms.

15. Governing law

These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts at Kolkata, West Bengal.

16. Changes

We may modify these Terms at any time. Material changes will be announced via an in-app broadcast. Your continued use after the effective date constitutes acceptance.
